Below is all the information you need to secure your booking. 

Booking is made up of two instalments:

  • To secure your date, there is a non refundable booking fee of £400 to be paid within one week of confirmation.
  • The remaining fee to be paid one calendar month prior to date of wedding. We will endeavour to send you a reminder e-mail close to the time but please note the date in your diary.
  • Album and additional print payments may be made upon order.

Bank transfer is preferred but cheque and cash are also options available if you cannot make a bank transfer. Your date can not be confirmed until cheques have cleared.
We work on a first come first served basis so do let us know if there will be a delay in transferring your fee. We do our best to give you first refusal on the date and will always inform you if someone else has enquired.

THE CONTRACT BIT

WHAT TYPE OF CONTRACT IS THIS?

This wedding photography contract is a ‘mixed’ contract which includes both ‘services’ and ‘goods’. The ‘services’ part may includes but is not limited to a venue visit, engagement shoot, wedding photography coverage on your wedding day, and the processing and editing of files afterwards. The ‘goods’ refers to the digital download of engagement shoot photographs and the USB drive that contains your wedding photographs and any book or album if these are included as part of your chosen wedding photography package.

 

WHO IS THE CONTRACT WITH?

The wedding photography contract will be with Lisa Byrne, trading as ‘Holly and Lime  Photography’.

WHAT’S THE TOTAL PRICE THAT I’LL BE PAYING FOR MY PHOTOGRAPHY PACKAGE?

The total price of your goods and services can be found on your personalised invoice. This will be supplied as a PDF for you to check prior to making payment. There’s no need for a signature, as the contract starts when payment is made. Please note, there is no VAT on the prices charged, so the price shown is the price you’ll pay.

 

ARE THERE ANY ADDITIONAL CHARGES?

Should you wish to add further coverage of your day by upgrading your package, there will be a further charge added to your contract. Engagement shoots will also incur a further fee. Any album or prints are payable upon ordering. These are not including in the ‘packages’. Album 14×10 inches in size or 8×12 inches in size (landscape or portrait format) and shall include 30 pages / 15 double page spreads which will typically hold approx 50 photographs of your choice. Should you want to upgrade your album to a larger size or to add more pages there will be an extra charge which is subject to the prevailing rates at the time the album is ordered. Due to the customers choice typically being made after the supply of wedding photographs, these charges cannot be reasonably calculated in advance, but up to date guidance is provided on the business website. Further retouching work, if requested, will incur a fee ie. blemishes, object removal. Should you wish to transfer your booking fee, there may be a fee if the change comes within 6 months of the initial date booked.

 

WHEN DO I HAVE TO PAY, AND WHEN DO I GET THE PHOTOGRAPHS?

Payment:

The payment is divided in to a booking fee and a balance payment. The booking fee is due on booking and the balance is due one month before the wedding date.

Services:

File processing and editing will commence following the wedding date and shall be completed within 8 weeks weddings between November – June or within 10 weeks for peak season weddings in July – October. The photos will be available to view in an online gallery once the editing is complete. A link will be sent to you via email.

Delivery:

A USB drive containing the wedding photographs will be delivered via Royal Mail Special Delivery to an address supplied by the customer.

 

WHEN DO I RECEIVE THE USB, PRINTS OR ALBUMS?

Your USB drive will be posted after any requested retouching work has been completed. Timescale for albums will depend on how quickly you are able to choose cover & content photos, and how busy I am when I receive your selection. I complete design work on a first come, first served basis so timescales will vary but I’ll advise of approximate timescales when I receive your photo selections. The book production time is 5 working days from the time I place the order with my suppliers. Album design does not take place in the months between July through to September. If you do wish to have your album within these months, your selection of images must be chosen before June 30th. Otherwise, album design will commence again on October 1st.
Prints are ordered through your online gallery, processed through a professional lab and delivered to you on their timescale. Holly and Lime cannot be held accountable for the timeframe in which your prints are sent to you but we estimate they will be processed within 5 working days of orders placed.

 

WHAT IF I HAVE A COMPLAINT?

Complaint handling policy:

Any complaints should be made via email.  Complaints will be responded to within 7 working days.

 

DO I HAVE A RIGHT TO CANCEL THIS CONTRACT?

Right to cancel; conditions, time limit and procedures in accordance with regulations 27-38. The consumer has a right to cancel at any time during the cancellation period without giving any reason, and without incurring any liability. Any written form of cancellation is accepted including email or text. 30(1) The cancellation period ends at the end of 14 days after the day on which the contract is entered into.

 

IF I CANCEL AFTER 14 DAYS, HOW MUCH WILL I NEED TO PAY?

If the consumer exercises their right to cancel after having made a request in accordance with regulation 36(1) which stipulate the request must be in writing, the consumer is to be liable to pay the trader reasonable costs in accordance with regulation 36(4).

Cancellation costs for cancellation requests received after the 14 day period are as follows:

14 days after booking and >1 year before the wedding date: £400 (booking fee)

14 days after booking and >6 months before the wedding date: £400 + 25% of balance

14 days after booking and <6 months before the wedding date: £400 + 50% of balance

AT WHAT STAGE WOULD I NOT BE ABLE TO CANCEL?

The circumstances (under regulation 28) in which there is no right to cancel: ‘The consumer ceases to have the right to cancel a service contract under regulation 29(1) if the services has been fully performed, and performance of the service began (b) with the acknowledgement that the consumer would lose that right once the contract had been fully performed by the trader.

The USB is the ‘goods’ part of this contract. In accordance with 28(b) of the regulations, as the nature of the wedding photographs are ‘made to the consumers specification or are clearly personalised’ the USB is exempt from the consumers right to cancel.

 

WHAT IF I CHANGE MY WEDDING DATE? 

Rescheduling Policy – If you reschedule the wedding date within 6 months of booking,  I will do my best to reschedule and transfer your booking fee to the new date. If the date is already booked by another client, that client’s date will be honoured and you will have the option to either reschedule again, or find another photographer who is available. All fees payable up to and including this date are still payable to me; as per the cancellation fees. Should you change your date within 6 months of the wedding date, a fee of £300 will incur as liquidated damages to The COMPANY. This is the result of missing out on bookings for the initial date.

WHAT IS THE LEGAL DUTY OF HOLLY AND LIME PHOTOGRAPHY IN THIS CONTRACT?

The service provided will be as advertised, and should Holly an Lime Photography be unable to provide this service due to unforeseen circumstances including but not limited to injury or sickness, Holly and Lime Photography is responsible for providing an equivalent service with an alternative photographer of an equivalent standard. The photographs supplied will be of a quality and style that is shown on my website and blog.

 

IS THERE AFTER-SALE CUSTOMER SERVICE?

I offer an after sales service available after the USB drive has been delivered should the consumer require any help, support or advice with using the photos or arranging their own prints or other products with the photographs. There is no end date to this service, however it may be limited in peak season months of July – October. Consumers are advised to contact me mid week should they require after sales service.

IS THERE A DEPOSIT TO PAY?

The booking fee is £400. The contract starts when this fee is paid by the consumer. This booking fee is not refundable after the 14 days cancellation period has expired.

 

ARE THERE ANY TECHNICAL PROTECTION MEASURES? (COPYRIGHT):

The copyright of the images remains with ‘Holly and Lime Photography’ as per the ‘copyright, designs and patents act 1988’. A licence is granted within this contract which allows pictures to be reproduced by the consumer for personal use. Pictures should not be supplied to media or commercial businesses. Should a media or commercial business want to use the photos, please ask them to contact me directly. The quality of my photos is really important to me so I like to supply correct size files if they are being used on other suppliers websites. Any commercial business that use the images without express permission from myself may be liable to a fine.

 

DO I NEED ANY SPECIAL HARDWARE OR SOFTWARE TO VIEW THE PHOTOS?

The wedding photographs will be supplied in JPEG format on a USB drive. The consumer will require a computer with a USB port to view the photographs.  The consumer will not require any specialist software as the photos can be viewed within standard Windows or Apple software that is supplied with their computer.

 

WEDDING ALBUMS

Wedding albums are designed in the quieter season between October – March. Album design is not available during July, August & September. Albums designs will be uploaded to an online gallery for checking, and couples are welcome to suggest changes and alterations at this stage.

As wedding albums are bespoke, hand made products that are individually commisioned for each couple they are exempt from the regular ‘returns’ part of the ‘Consumer Rights act 2015’, with that in mind it’s important to take the time to fully check design and cover proofs that will be emailed to you. The albums I supply have a lifetime warranty, so should any defect or fault appear at a later date, the album can be returned to me to be repaired.

Album design is a collaborative process involving input from couples in choosing and sharing album photos with me and advising of preferences with design and customisation. The time involved in designing wedding albums can vary considerably depending on the features of your design. If your album design will feature lots of personalised elements, the process will be longer and require more input from you.

There may be software & printing limitations that will affect what changes are possible and should these affect you, I’d advise of this during the design process.

In the unlikely event that I’m unable to design your album to your preferences, my liability will be limited to a refund of the album cost, which will be shown separately on your contract.

 

WEDDING ALBUM STORAGE

Wedding albums are temperature and humidity sensitive and should be stored at room temperature and not in a loft or out building. Warping of the pages can occur if they are stored below room temperature or in humid conditions. Page warping is not covered by the warranty, but if this does happen, pages should return to normal within a couple of weeks of correct storage. Wedding albums should be stored flat to protect the spine, unless advised otherwise.

 

RIGHT TO CANCEL

You have the right to cancel this contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day the contracts starts, which is the day the booking fee is received. To exercise the right to cancel, you must inform us, Holly and Lime Photography, of your decision to cancel this contract by a clear statement (e.g. letter sent by post or email).

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Effects of cancellation: If you cancel this contract, we will reimburse to you all payments received from you. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise, in any event, you will not incur any fees as a result of the reimbursement.

If you requested to begin the performance of services during the cancellation period, you shall pay us an amount which is in proportion to what has been performed until you have communicated us your cancellation from this contract, in comparison with the full coverage of the contract.

 

This information pack is supplied in accordance with ‘The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 which came into force on 13th June 2014.This pack provides all the relevant information you need to know before entering in to a contract with ‘Holly and Lime Photography’.Consumer Information supplied in accordance with Schedule 2 & 3:

THE WEDDING DAY

ENTIRE AGREEMENT: This agreement contains the entire understanding between the COMPANY and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties. In the event that any part of this agreement is found to be invalid or unenforceable, the remainder of this agreement shall remain valid and enforceable. Any agreement to waive one or more provisions of this agreement or any failure by one or both parties to enforce a provision of this agreement shall not constitute a waiver of any other portion or provision of this agreement.

RESERVATION: A signed contract and retainer fee are required to reserve the dates and times of the EVENT(S). If the EVENT(S) are rescheduled, postponed, or cancelled; or if there is a breach of contract by the CLIENT, the retainer fee is non-refundable and shall be liquidated damages to The COMPANY. The CLIENT shall also be responsible for payment for any of the COMPANY’s materials charges incurred up to time of cancellation.

EVENT SCHEDULE: The client agrees to confirm the schedule one-month prior to the EVENT(S). Notification of any changes in schedule or location must be made in a timely manner and confirmation of receipt must be obtained from the COMPANY by the CLIENT.

SAFETY: The COMPANY reserves to right to terminate coverage and leave the location of the EVENT(S) if the photographer from the COMPANY experiences inappropriate, threatening, hostile or offensive behaviour from person(s) at the EVENT(S); or in the event that the safety of the photographer from the COMPANY is in question.

SHOOTING TIME / ADDITIONS: The CLIENT and the COMPANY agree that cooperation and punctuality are essential to accomplish the goals and wishes of all parties. Shooting commences at the scheduled start time and ends at the scheduled end time. If the CLIENT does not arrive at the appointed time for the EVENT(S), shooting will commence at the scheduled start time and end at the scheduled end time. All additional time beyond the scheduled end time will be billed to the CLIENT. THE COMPANY’s cut off for any one working day is 12 hours from scheduled start time. 

EXPENSES INCURRED: When applicable, the CLIENT is responsible for all travel, accommodation, meal and transport costs unless provided by the CLIENT.

MEAL: The CLIENT agrees to provide THE COMPANY with a hot meal at the venue as and when THE CLIENT is having theirs. This time is considered a break for THE COMPANY to refuel in time for further work post meal. THE COMPANY do not need to be included in the seating plan with the wedding guests. They will often sit in a neighbouring room/ bar area. Please make the venue aware that THE COMPANY need to eat at the same time as THE CLIENT so as not to miss the likes of speeches after dinner, cake cuttings etc. Should the venue fail to provide THE COMPANY with a meal at this time, THE COMPANY shall not be held liable if photo opportunities are missed whilst eating their meal. 

TRAVEL EXPENSES: All travel expenses are based on the distance between the EVENT location(s) and the COMPANY studio address. For all EVENT(S) within 2 hours driving time of Derry City, the travel is free of charge though accommodation fees and other expenses may incur. Any weddings booked outside of Ireland, will incur travel and accommodation fees to be discussed at time of booking.

RESPONSIBILITIES: The COMPANY is not responsible for compromised coverage due to causes beyond the control of the COMPANY including but not limited to obtrusive guests, lateness of the CLIENT or guests, weather conditions, schedule complications, incorrect addresses provided to the COMPANY, rendering of decorations, or restrictions of the locations. The COMPANY is not responsible for backgrounds or lighting conditions which may negatively impact or restrict the photo coverage. The COMPANY is not held liable for missed coverage of any part of the EVENT(S). The COMPANY will not be held accountable for failure to deliver images of any individuals or any objects at the EVENT(S).

VENUE AND LOCATION LIMITATIONS: The COMPANY is limited by the rules and guidelines of the location(s) and site management. The CLIENT agrees to accept the technical results of their imposition on the COMPANY. Negotiation with the officials for moderation of guidelines is the CLIENT’s responsibility; the COMPANY will offer technical recommendations only.

PERMITS: The CLIENT is responsible for acquiring all permits and necessary permission for all locations on which the COMPANY will be performing services.

MODEL RELEASE: The CLIENT hereby assigns the COMPANY the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT may be included, for editorial, trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same without restriction. The CLIENT releases all claim to profits that may arise from use of images.

CAPTURE AND DELIVERY: The COMPANY is not liable to deliver every image taken at the event. The determination of images delivered to the CLIENT is left to the discretion of the COMPANY.

POST PRODUCTION AND EDITING: The final post production and editing styles, effects, and overall look of the images are left to the discretion of the COMPANY. The CLIENT is not given permission to alter, edit or crop  images by use of editing software or filters. Cropping, where unavoidable, is allowed in these circumstances.

EXCLUSIVITY:  THE CLIENT agrees that THE COMPANY are to the only photographers hired for the EVENT.

AGREEMENT

By submitting your details, you confirm you agree to the contract above and are happy to allow Holly and Lime Photography the use of your images.

We will never sell your images on to third parties. We may only use some of them on our website or social media to share with others, your family and friends and it helps other find us, just like our other lovely couples whose photos we shared that helped you find us for your day! 🙂 

We don’t often get the time to blog weddings so we unfortunately we can’t share every wedding we photograph. Although we would love to. Though we do try to share a few images here and there. We love to share the odd wee sneak peak on Instagram or Facebook (which is always a lovely photo of you both) to (hopefully) get you excited about seeing your full gallery! We really appreciate you letting us do this so we can continue to share our work. If we share a photo from your wedding, it just means we absolutely loved it and want to share it with everyone!

Sometimes there’s an extra special photo we took on the day that we would absolutely love to share on our website, even if we don’t manage to blog your wedding. And sometimes wedding blogs like One Fab Day, Rock n Roll Bride etc, get in touch with us when they see a photo from one of our weddings. If they see it and would like to feature your wedding, we get a little bit excited but we will never share your images with them without getting in touch and asking you first. We appreciate that some people would rather not do this so if someone does want to share your wedding, we will drop you a line and let you  know. Normally, there’s a questionnaire for you to fill in about your day. It can be rather lovely to see your wedding featured and it definitely gets us excited to see our work on a big, fancy wedding blog but again, we will always ask for your permission first so you won’t see your wedding randomly pop up on some other website without giving it the go ahead. 

Sometimes, we have couples who initially don’t want to have their photos seen on the internet but later on have loved them so much that they have come and told us they are more than happy for us to share them. If you have reservations now  but change your mind later, please let us know!
